The Accused Revisited: How Hollywood Exposed Victim-Blaming in 1988—and Why it Still Matters

Former AEquitas Senior Attorney Advisor Patti Powers discusses The Accused (1988), a film that exposed the reality of sexual violence and the way victims are often put on trial themselves. Drawing on nearly three decades as a prosecutor, Patti examines the real-world issues it reflects and what has—and hasn’t—changed since its release. They explore the challenges of prosecuting cases involving voluntarily intoxicated victims, multiple offenders, and deeply traumatized victims—and why listening to survivors remains the starting point for justice. Patti offers insight into case-building, corroboration, accomplice liability, and the dangers of charging a case based on the speculation of what a jury would do rather than what, applying the law and evidence, they should do. This conversation highlights how far the field has come since 1988, and the work still needed to ensure victims are heard, respected, and supported in sexual assault prosecutions.
