New Hampshire Coalition Against Domestic and Sexual Violence - Press Release | Attorney for Family of Lizzi Marriott to Defend NH’s Rape Shield Law before the NH Supreme Court
(09/20/2016) Lizzi Marriott was raped and murdered in 2012 by Seth Mazzaglia, who was convicted of first-degree murder and sentenced to life in prison in 2014. During the appeal process, the NH Supreme Court, unprompted by the defense, ruled that documents outlining Marriott’s past sexual history were to be unsealed per a new NH Supreme Court Rule that allows documents that are sealed during trial to be unsealed once a case is appealed. As a result, records of Marriott’s past sexual history would be made available to the public. [ . . . ]
This case has sparked a tremendous amount of interest among national victim advocacy and legal organizations, as the NH Supreme Court’s ruling disregarded longstanding victims’ protections, and serves to expose victims’ past sexual histories. As a result, all eyes are on NH and these proceedings will stand out as a landmark case for victims’ rights nationwide.
